Indeed. Although it's quite possible, from the kid's comments, that he might straighten himself out and learn from his mistakes. But RU can't afford to take chances at the moment. Not after last year's issues.

The woman didn't claim it was non-consensual. She said if she was sober she wouldn't have had sex. Big, huge difference. Heck, she started drinking even before meeting w/him. She's accepting responsibility for getting drunk and making bad decisions. I actually liked her for drawing the distinction.

Being drunk and making bad choices is not other people's fault, except when there are extenuating circumstances (e.g. under age).

The video was another thing, and she apparently didn't consent to that, drunk or otherwise.

According to the article, he didn't sent it to anyone else, or at least there's no evidence of that.

He sent it from his phone to his laptop, and then to her. That's where the transmission charge comes from.

I must say that after reading the police reports, this sounds like it's been incredibly overcharged. Another erxample of law enforcement run amok in this country.

I don't think the consensualness extended to the video. And it's not entirely clear that he sent it to anybody - I think the police have yet to find evidence of that. Or maybe I missed it in the article.

The sex was consensual. A mistake, according to her, but consensual. The video does not appear to be consensual. And certainly if he did send it out, that was also non-consensual.

Ok.... Makes for an interesting case.... At a minimum he gets in trouble for the video..... I guess the video might show how receptive she was to having sex, but will that even matter?.... Agree we should have stayed away from this

He's not being charged with sexual assault, so it's unlikely she's screaming "no" or resisting very hard.
 
15 seconds, and no one saw it but either of the parties involved. Not exactly the crime of the century.
I agree but in this day and age, it's gonna get you in trouble (as he found out). I'm not going to judge this kid as a bad kid (just for that). Seems more like a dumb mistake. But this kid needs to realize what he has to lose and start making better decisions.

Sounded like he understood that already from his comments.
