I agree that it could be more clear.
"Attorney William Fetky appeared with Carroo at a court hearing Wednesday in New Jersey. A woman Carroo is accused of attacking after a Sept. 12 football game is seeking a permanent restraining order against him." Still, I'm pretty sure the adjournment is for the restraining order being sought, not the actual criminal court proceedings.
 
The restraining order case could be huge as far as his suspension. If the victim is still a recruiting host would the Hale Center be considered her place of work and the restraining order could potentially bar him from the building?

Also, if the assault case is thrown out because the evidence indicates that Carroo is innocent (as many here seem to believe will happen), then it is unlikely that a restraining order would move forward.

I don't think we can assume that the RO is dropped at the same time as his criminal charges (Assuming the case is thrown out today).

I *believe* they still need to get in front of the other judge to present the criminal charges being tossed.

I can't see him being reinstated before the RO stuff is sorted out.

Let's see what happens today. But now that I think about it, this weekend is a well-timed bye. Theoretically, Carroo could be back on the field vs. MSU in a best-case scenario.
 
Isn't this just a preliminary hearing? The prosecutor will outline the case to the judge and Carroo will plead not quilty. A trial date will be set. This isn't the trial. I don't see where Carroo's situation changes and he gets off today.

Presumably, the prosecutor sees that his main witness told 3 different stories to the media and a the defense has a witness who is willing to testify he did it. Why would you prosecute a case you're likely not going to win.

The girl ruined her own credibility with her public comments, whether LC gave her the Stone Cold Stunner or not.

Yes, and that's exactly why lawyers generally don't want their clients speaking directly to the media. When people make comments right after an incident and emotions are raw they may not communicate the facts clearly. Not to mention the press gets a lot of stuff wrong or takes things out of context.

Look, I've been tough on LC from the start. And I was in early on thinking the entire shit show could have been avoided if he acted differently. And he surely showed poor judgement all the way around.

But, this girl has not helped herself by speaking to the media. Right, wrong or indifferent, she has made this case very difficult for the prosecutor to win. LC's lawyer is a connected guy. I've never thought his sees a trial. Her comments make that even more unlikely. I would be surprised if this isn't resolved today. Not totally shocked, but mildly surprised.

I have only seen one story of her speaking out. The Bergen Record interview.
 
As I've said before I doubt there'll be a swift resolution. The prosecutor won't drop this unless there's zero doubt Carroo is not guilty of anything because of the publicity. The defense has a responsibility to show LC is completely innocent because any doubt will hurt Carroo's future big time.

Even if it takes another month it'd be better for all concerned to come to an undeniable resolution if one exists.

I can't recall where I saw the other story, but it may have been the Targum, not sure. But honestly White Bus, as I mentioned before, most lawyers would say that's one story too many. They would rather be doing the talking for their client or reserve comment altogether.

There is nothing in the Bergen Record interview that contradicts the prosecutions case. Some of the other quotes about her knowing it was LH because of his size have not seen anywhere but boards and in comments sections of stories so I'm not sure they are real.

In any event. Unless she goes to court and recants everything there is a very small chance he's exonerated in court today. People shouldn't get their hopes up that he will be on the field by the MSU game. The legal system never works that fast. Nor does the legal system care that he is suspended and needs a quick resolution.

Based on this being RU administration and not to mention she was a Rutgers employee.
I can see the RU propeller heads and lawyers NOT reinstating just to cover their butts from an impending klawsuit from the alleged victim....what a soap opera this can continue to be.

From what some on this board have posted, they expect Carroo's attorneys to present video and witness evidence to the judge that so clearly shows that Carroo is innocent that the case will be tossed.

I have no idea if that will happen or not. But the likely outcomes of today's hearing are either (a) the case gets tossed, or (b) the case goes to trial.

If outcome (a) happens, then I would expect Carroo to be back on the team and the restraining order to get tossed as well (if not today, then shortly thereafter).

If outcome (b) happens, then I expect Carroo to be off the team and the restraining order to remain in effect until after the trail (which may be after the end of the season).

In a preliminary hearing, the state must meet a threshold of showing that the case should proceed to trial.

Witnesses will be called, defense can cross examine, and then the judge decides whether probable cause exists.

Not arguing any of that, just speaking in general terms. Why open anything up to question by speaking to the press before your day in court? It's just not worth it. And as Hudson said, she is saying one thing in the press and there is a guy willing to say she's wrong, he did it, not LC, so that's an issue.

This is America. If charges are dropped because of a lack of evidence, then the officials at RU need to reinstate Mr. Carroo. This is not a he said she said case. There were witnesses. If the testimony from the witnesses or the video clear him, then the suspension should be over.

If it goes to trial, he won't be back.

Does anyone know if he is still on scholarship? Did he still get his stipend? Can he work out at the Hale Center individually?
