Indiana has a "Romeo & Juliet" law, which decriminalizes consensual sex if the parties are within 4 years of each other's age. It still only applies to those 14 years of age and older. Hence the charge. If she was 13 or less, it's still a felony.

Yes, it does depend on when it occurred, but the age difference (i.e., how old he was when it occurred.) usually has to be pretty small.
