He alleging a slow response. Penn State side of the story said he refused to make a formal complaint that they could act upon. We will have to let the court decide which side is the truth.
I don't trust Penn St to put out a completely honest response and sure a deal will be reached paying the kid off, but part of that deal will be:
not to divulge the amount PSU paid and not talk about anything in the lawsuit again.
Then Penn St will announce a settlement acknowledging the Fraternity violated PSU's rules and that's why Penn St settled.
But will make a point of saying because of no formal complaint was made the investigation process took longer than they liked , but they acted as quickly as they could on the matter and took care of it despite no formal complaint was made.
I doubt the court will decide which side is the truth, the suit will be settled before the court decides and the truth will not get out, unless Penn St
decides it must prove it did it's best and goes all the way to do that by letting the court decide whose telling the truth.
Could be , because of no formal complaint, Penn St did what it could do and Vivenzio is only after money , not justice.
If Penn St did what it claimed ( offered him assistance on numerous occasions) and the Vivenzio didn't take them up on that and refused to file a complaint, provide documentation, speak with State College Police or participate in pursuing the formal disciplinary process, could be Penn St is getting a bum rap and the court will rule in their favor.
