OT-Sarkisian Sues USC for Wrongful Termination

All attorney talk. If this one gets past the first stage/hearing then God help out entire legal system. Yes he may have a sickness but then where is his family, legal counsel and agent before this and all along the bad steps he may have made as well as his own self respect. Now he wants help and cash to boot? Maybe the first thing he and his legal team should do is to check him into a facility to help him get his life together.
 
So he is saying that they should have kept him on staff because he drinks too much and can't control his actions in a public environment?

Damn, if this flies, then I am gonna hit happy hour during lunch everyday!!
 
Will all pivot around the USC employee substance policies - and whether they were properly & adequately followed - opinions about alcoholism will have zero bearing on the matter.
The dicey aspect of a situation like this where the employee is way high up in an organization & then the interactions & management is being predominantly handled by someone even higher up - is that decisions sometimes get made based upon expediency, politics, reflexive instincts, anger ... and sometimes the procedural details that apply to all employees get over-looked (and that can cut both ways - too lenient & too strict )
- this will definitely be a "the devil is in the details" kind of case .... and it is all about the $$$
 
He alleges that he advised USC about his disability and sought treatment BEFORE he was fired. They are in California, land of the fruits and nuts, so anything goes. IMO USC will shovel millions at him before all is done.

The fact that he was suspended one day and fired the next makes it appear that USC wrongfully terminated a disabled employee simply to avoid its contractual obligations in violation of applicable disability law.
 
My guess is that this ends with a quiet settlement. USC doesn't want this hanging over their heads and if half of what's alleged in the suit is true it isn't a good look for the university.

This is the law, if he tells his employer he is an alcoholic and wants help he cannot be fired. Happens all the time. However, it he repeatedly denies he has a problem and refuses help or treatment, as USC is saying, then he is beat. Sounds like a lot of he said/she said, I'm sure it'll be settled quietly.
 
cancer is a disease...alcohol is a choice...and before anyone says anything.. yes I do drink.. and I'm a former smoker who quit cold turkey ( I chose to smoke, and when I quit I've never looked back..my choice)
 
An employer cannot fire someone for alcoholism because it is a protected disability under the law. . However, an employer can fire someone for showing up drunk at his job and otherwise screwing up because of drunken behavior.
