If Carroo has the charges dropped, etc. , does he have any legal recourse against the accuser? Or is this kind of like when the football refs don't overturn a ruling on the field due to insufficient evidence?
He may well have to deal with the history of this for a long time and I would think a very solid argument could be made that his name has been harmed not to mention his future earnings as a pro.
 
Not a lawyer, but very familiar with NJ's Domestic Violence Laws. No Carroo, has no recourse against the accuser. I posted in another thread an article that the morris County Sheriff was accused by his wife of DV. She dropped the charges. He says in the article that there is no mechanism by which the falsely accused can charge the accuser with a crime of false accusation. This is why we need to change the standard of evidence to the "Clear and Convincing " standard. I will post the article when I have a chance to find it.
 
Once claims are dropped, the last thing someone in Caroo's position (potential NFL'er) wants to do is remind the world of what has transpired and suing her or the state (which most people don't do anyway) would do just that and would result, in any event, in damages, if any, that would be hard to quantify, especially if he returns to the team and is drafted by the NFL - even if not in the first round.
 
No it doesn't. In fact as you can read, he agreed to counseling in order to have the charges dropped. The charges can be reinstated later on if he fails to comply.
It absolutely does mean he was innocent! He entered into a consent order(both parties draft the terms and agree to it outside the purview of the court) to expedite the proceedings. He only agreed to this so that he can salvage the rest of the season.
This is the problem with the family courts in NJ, even when he is innocent he still has to go through BS classes just to clear his name even though he did not do anything. Bottom line is he is cleared and should be reinstated tomorrow by RU.
