Carroo charged with simple assault under domestic violence

Certain crimes that occur during a domestic situation require an arrest under DV laws.

This. The Domestic Violence component actually has nothing to do with the charge, it simply means that the police are obligated to make an arrest.

The Simple Assault charge is actually a gift for Leonte. In New Jersey, simple assault is a Disorderly Persons offense and is usually a walk-away if the defendant has no prior record. Maximum penalties are something like "up to 6 months and up to $1,000", but that's pretty rare.

a. Simple assault. A person is guilty of assault if he:
    • (1) Attempts to cause or purposely, knowingly or recklessly causes bodily injury to another; or
    • (2) Negligently causes bodily injury to another with a deadly weapon; or
    • (3) Attempts by physical menace to put another in fear of imminent serious bodily injury.
    • Simple assault is a disorderly persons offense unless committed in a fight or scuffle entered into by mutual consent, in which case it is a petty disorderly persons offense.

A simple assault conviction is typically a disorderly persons offense. Where the simple assault arises in the context of a consensual fight or scuffle, then it is a petty disorderly persons offense. If the intended victim of a simple assault is, however, a police officer or some other public official, then the offense becomes an indictable felony charge. A simple assault committed on a public official, such as police officer, is a Third Degree offense if it results in bodily injury but otherwise it is a Fourth Degree Crime. The criminal lawyers at our firm are often successful in obtaining a downgrade of a simple assault charge and/or dismissal altogether.

Sounds like that falls into the petty disorderly persons offense category which to me is not indicative of punching a woman.

it doesnt matter what he was charged with. he's done with the football team.
 
it's a domestic violence arrest. in today's climate that is a death sentence.
 
And here is why it would qualify as DV. Victim falls into one of the below protected classes pursuant to NJSA 2C:25-19:

“Victim of domestic violence” means a person protected under this act and shall include any person who is 18 years of age or older or who is an emancipated minor and who has been subjected to domestic violence by a spouse, former spouse, or any other person who is a present household member or was at any time a household member. “Victim of domestic violence” also includes any person, regardless of age, who has been subjected to domestic violence by a person with whom the victim has a child in common, or with whom the victim anticipates having a child in common, if one of the parties is pregnant. “Victim of domestic violence” also includes any person who has been subjected to domestic violence by a person with whom the victim has had a dating relationship.

Here's the question though: Does Leonte get kicked off the team if it weren't for the 5 other guys arrested and kicked of the team? Even if he was simply protecting his mother?
 
Maybe he will be reinstated for the Penn State game. Carroo is a good guy I don't know what the circumstances were that made him do that.
 
Why would a player be dismissed for a simple assault charge?

I could see 1 to 4 games, but the season?
I would suspend him for 6 games. If this was done in a vacuum and the last month of BS never happened then I would agree with less. The fact that it came on the heels of everything else and he was told not to go outside by his team-mates shows that he lacked judgement.

and at the moment, the only real word on the situation is that he's been charged with simple assault.
 
The Florida State kids always seem to come back. One game should be enough. Remember this will hurt him with pro people so that is a lot right there.

It was based on a DV incident though. There are different levels of DV and when stalking or some other issues aren't involved, this is a lesser charge to use, but it is still a DV. No sugarcoating this. No way he is back on the field this year unless by chance the security cameras at the Hale Center caught it and it absolves him completely.
 
Unfortunately the ghosts of the Ray Rice incident are going to haunt him. Right, wrong or indifferent I'd say his playing day at RU are over. The media is going to crucify this kid for a momentary lack of judgement. That's how they do it NJ and it's flat out sucks.

I slightly disagree. There is no video, and this is a mere simple assault. Completely different circumstances. Also we don't know how this went down. Details play a factor when there is no film

I would think it's better to leave him off the team. It's his second suspension of the season. Flood needs to put his foot down on this one.
 
Jeremy Hill was on tape knocking dude out in a parking. Missed three games. If flood feels a 3-6 game suspension is enough, then it's enough. We still don't know what happened. We pretty much knew he was about to be arrested. If Politi doesn't agree with a 6 game suspension, then f' him. We're already hated.

Exactly.

Just think for a sec, not long after a crushing loss, he hears of something going on outside with his family involved.
Put yourself in his shoes, sure we would hope that he would try to have a cooler head and that teammates would basically try to restrain him and call the coaching staff over to squash it.

But, w/o knowing what actually happened we can't make blanket statements such as he should be dismissed especially when other players in similar situations across the country were not dismissed for similar actions.

Hopefully you are right, but it sounds like this isn't a he said/she said situation. Apparently plenty of witnesses. Like I've said in another post, by all accounts Carroo is a stand up kid who made a mistake and should not be punished above and beyond for the offenses of others.

From what I heard, He will be suspended for the 1st half of the Penn St.
game and Flood has decided to use Rettig for the 1st half only. Then Carroo
and Laviano will play the 2nd half.
 
I don't find anything "minor," about this, but what happened to comments from yesterday like:

- "his NFL career is over"

- "his draft status is screwed"

- "he lost millions"

- "when you hear what he did it will turn your stomach"

..and other such comments? Do these charges seem, let's say, "light" in lieu of the actual circumstances or were some posters embellishing the past 24-hours or so? I have NO idea, and am not faulting anyone, just searching for answers. Thank you.

I have heard other eyewitness accounts which directly support this.
If that were accurate, then he would've been charged with aggravated assault.

Simple assault under DV could mean something as little as he pushed a girl(friend) or screamed at a girl & it may have been to help/defend a relative or another girl based on the rumors.
