I also agree with Rube, that there's no chance this will be heard en banc.I thought that the lower court Judge clearly overstepped his bounds in vacating the arbitration award. There's a strong federal judicial policy of enforcing arbitration awards that draw their essence from the CBA. The Judge acted more like a Patriots' fan than a Federal Judge.

To your other point, Fox had one of their talking heads basically saying the same thing. Saying this is a non issue and the commissioner needs to "do the right thing" and drop it. I love the "drop it" argument. Nobody was saying that when Brady won round one. Everybody was saying that the league didn't have a snowball's chance on appeal. Worm turned and now it's all, "Let's just forgive and forget." Interesting to see if Goodell will have any part of that. And if he offered two games, whether Brady would take it, or fess up that he was guilty all along?
