Interesting. My experience (not an attorney) but usually the person bringing litigation forces the action with their deposition lists and requests. Unless of course they think it’s a frivolous case.
Why would the ACC who you’ve said is in a position of weakness want to expose themselves in a deposition process? Crazy tactic.
