Trademarks are very specific. Rutgers has a trademark for the use of it on clothing, footwear and headgear in connection with football. They don't have trademark that prevents people from using the slogan or even for example a baseball team using it on clothing. Schiano wasn't the first to use the slogan. I remember my youth coaches using it..it just became synonymous with the Rutgers program. It the same way Penn State fans get all bent out of shape when other schools use We Are. No Penn State didn't event it but has become known for it.. The movie about the Marshall football teams tragic plane crash is actually titled We Are Marshall. So they were using it in the early 70s.
