Thats already assumed. Before re-opening my business I talked to an attorney who specialized in liability etc and he said the reason youve seen zero successful suits regarding business liability for corona is the plaintiff would have to prove beyond a reasonable doubt they contracted a) at your place of business b) it was directly because of your business c) prove who they contracted it from d) show evidence everyone they interacted with over a 14 day period didnt have corona.

theres no liability to open to full capacity
weird how it is such a big deal for some in the senate that laws are passed to shield businesses from this liability even though according to you they will never be found liable.

It is not weird at all if one understands how the legal system works in the U.S. Just because there is little likelihood of success doesn't mean someone won't sue for something, which would cost a small business a lot to defend. Debate the merits of such a law if you want, but the fact that it would have an effect (i.e. creating certainty and a low cost resolution) is not in question if one has any experience with business or law.

if the lawsuits are frivolous they will be dismissed on papers, and court costs will be awarded to the business.
 
Not in some states now, which is simply stupid. Daily cases in Texas, for example, have levelled off at about 75% of where they were during the summer peak, which is still way too high for opening things up 100% without masks. It's not just stupid, it's criminally stupid.

RU better have a policy and plan in effect soon. Just because the first game isn't until September everything has to be in place. Security hiring, food handler, stadium workers, etc.

Just don't complain if you can't get into the games. Or if you have to mask up because we're still not where we need to be.

Until masks are not required in the Democratic Peoples Republic of New Jersey, I have no interest in attending. Can you imagine the Middlesex Sheriffs office going crazy writing tickets since they can’t mess with underage drinkers anymore? I can. No thanks. I’ll enjoy watching the games from Florida.

Again, those who understand the law and business know that negligence tort cases aren't generally dismissed at the pleading stage because of lax pleading standards. There would not be facts required in a pleading at that stage, in general. If a case is won on assumption of risk, that too won't likely be dismissed right away. But even ignoring all that, moving to dismiss takes time and costs thousands of dollars. Even if successful there or later in the case, most states are pretty stringent with awarding attorney fees. Then, even where they are awarded, a judgment is not the same as collecting (which also can cost more money).

I'm not sure there will be a plague of covid-lawsuits because there doesn't seem to be an easy payout for the type of attorneys that would take small cases. So there's a chance it may never become a problem. But a law would certainly help business, at least by avoiding the uncertainty over whether that will happen. Thinking that there won't be a problem just because the business would win the case is a notion based on maybe how the law practice exists in movies, but is not tethered to real life litigation practice.
 
I'm pretty sure nobody has won $1 suing a business that has been following the Goverment rules. It's a pandemic. It one of those things that you really can't sue for.
The problem that RU could have would be IF they were to say something like "people need to wear masks if they come inside the stadium" and then dont enforce it. Or say that they are cleaning all the surfaces and not or something else that they commit to doing safety-wise where when people decide to come to the game they expect those measures to be happening. The 'come at your own risk' disclaimer posted on their site, on the ticket, at the stadium, etc would prob be enough (as long as RU didn't also commit to any of those plans i mentioned above).
I dont think people will win a suit simply for getting sick because RU didnt ask for vaccine confirmation of all attendees. And the sick person will never be able to prove they got covid at the game.

Not mandating signs in public places etc. showing fire snd emergency exits isn't stupid

Not taking the time to investigate your fire/emergency pathways and exits in every situation is stupid.

Point is......in many, if not most cases ......both things can be stupid....especially in a society that is filled with stupidity and entitlement.

Take em out back and beat the living shit out of them seems to work for other things...obviously kidding, but what could go wrong combining lots of liquor and a stadium filled with people who are probably willing to brawl with each other over masks? If everyone is vaccinated, there won't be a need for masks - you'll see.

Nobody brought up either one of those 2 lol and one of them is a bonafide criminal so it’s unlikely that people will stop talking about him nor should they.

You also need to read the thread more closely - they were brought up before I mentioned them, which is why I brought them up again...

A quick summary judgement motion should not cost that much money.

There has to be an incentive for people to get vaccinated. If you get the shots and nothing changes why would some people think they should get it? If you still can't see your family, go to a restaurant that is fully open indoors etc why get vaccinated? There has to be a promise of going back to normal. In PA and NJ restrictions fading anytime soon isn't happening.

I agree but a stadium with EVERY fan being vaccinated isn’t realistic.
 
There has to be an incentive for people to get vaccinated. If you get the shots and nothing changes why would some people think they should get it? If you still can't see your family, go to a restaurant that is fully open indoors etc why get vaccinated? There has to be a promise of going back to normal. In PA and NJ restrictions fading anytime soon isn't happening.

Getting back to normal is the incentive. The people that need more incentive than that are the same a-holes who are unwilling to get a little prick in the arm that might just f it up for everyone. And then complain the loudest.
